CHASKI GREEN – TERMS & CONDITIONS 2021 – 2022

Chaski Green Tour Operator wants you to enjoy your holiday of a lifetime with complete success. Please take your time to read and understand the conditions of booking set out below prior to booking a trip with us. We strongly recommend that you also read the package trip Information relating to your tour to ensure that you understand the itinerary, style and physical demands of the trip you are undertaking.

1: Our contract  

All bookings are made with Chaski Green Tour Operator. By booking a trip package, trek or tour with us you are deemed to have agreed to these Terms & Conditions (which constitutes the entire agreement between you and us) The services to be provided are those referred to in your booking confirmation invoice.

2: Validity 

Dates itineraries and prices are valid until 31 January 2022

3: Health

Good health and physical fitness is required on all trips specially if you are planning to do a trek with us. We recommend a physical examination for all travelers and trekkers on extended trips and you must have a copy of your examination while you are in Perú.

4: Insurance

Get insurance! Even if you are only going on a short trip, you should always travel with insurance. Have fun while visiting Perú, but take it from someone who has racked up thousands of bucks on an insurance claim before, you need it!

As a wise man once said, if you can’t afford travel insurance, ¡you shouldn’t be traveling so be sure to get your backpacker insurance sorted before you head off on an adventure! We highly recommend World Nomads Insurance

It is a condition while booking a trek with Chaski Green Tour Operator that travelers/trekkers must be protected by insurance that covers cancellation, accidents, health, emergency evacuation, and loss of items, theft of or damage to baggage and personal effects, it is important that any insurance policy issued to cover emergency evacuation for a trek does not exclude alpinism or mountaineering, at least that covers above 4500 m.a.s.l./14,760ft. Rescue insurance is not available in Perú.

You must provide your travel insurance policy number and the insurance company’s 24-hour emergency contact number on the time of your booking; you will not be able to join the trip without these details.  If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank’s name and credit card details.

5: Flexibility 

You understand and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip or tour is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events that always happens in Perú. If you are coming to Perú just to complain or make more difficult our best organization Chaski Green Tour Operator will automatically cancel your trip, tour or trek.

6: Assumption of Risk

The traveler/trekker understands that during the course of the trip, certain risks and dangers may occur, including, but not limited to, the hazards of traveling in mountainous terrain, accident or illness in remote places without medical facilities, and the forces of nature. The traveler/trekker agrees to assume all risks associated with the journey, and agrees that no liability will be attached to the company or its outfitters, employees or agents, or to any member of the tour group in respect to death, personal injury, illness or delay of traveler/trekker, or for any loss or damage to the property of the traveler/trekker during the course of the trip, howsoever caused.

7: Acceptance of risk 

You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. Perú does not have the same facilities that you might have in your country, Perú does not have same infrastructure that you have in your country. ¡PERÚ IS TOTALLY DIFFERENT COUNTRY THAN OTHERS!

WEATHER IN PERU

We get a lot of crazy weather here in Peru. So much, in fact, we are one of the top worlds countries with the most unpredictable weather, so DO NOT UNDERESTIMATED AND BE PREPARED FOR FIVE SEASONS – Chaski Green does not guarantee the best weather, for which you must be prepared. There will be sunny, cloudy, foggy, rainy days with storms and even landslides, overflowing rivers that escape of our control. The guide and the agency are not to blame for the bad weather, however, Chaski Green will do everything possible to help you get to your destination safe; If there are a change of plans during your tour, the guide will contact the agency as soon as possible and we will try to support and reorganize as fast as we can. THIS MAY MEAN SOME ADDITIONAL COSTS THAT ARE NOT INCLUDED IN YOUR PACKAGE OR TOUR.

8: Change of itinerary

Before departure:  If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.

After departure:  We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control.   In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Chaski Green will be always monitoring and help if it’s necessary. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries such as visas, vaccinations or non-refundable flights or just your personal decision to change the Itinerary.

9: Authority on tour  

Our group trips or tours are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveler or staff member participating in the trip or tour. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all places visited, and you also agree to travel in accordance with our responsible travel guidelines.

10: Deposit requirement to confirm a booking

  • A deposit of US$ 200 per person is required to confirm a booking.
  • All flights (domestic and international) must be paid 100% in advance to secure spaces.
  • Cruise bookings are subject to special deposit policies depending on the boat.
  • If booking is made 60 days or less prior to departure, full payment is due.

11: Full payment and reconfirm of booking

  • Full payment or balance of payment must be paid 60 – 50 days before trip departure date.
  • As soon as we receive the full payment; we will send you an email re-confirming your booking.
  • If you are booking a Perú Package is made 60 days or less prior to departure, full payment is due.
  • If full payment or balance of payment for Perú Package is not paid on or before the due date, we reserve the right to treat your booking as cancelled.
  • We would appreciate payment in full before you arrive in Perú.

12: Payment methods

  1. c) PayPal

We accept payments through PayPal; by this payment method PayPal charges a commission of 6% and you must pay it. (Example: Initial amount US$ 100 + PayPal 6% charge you must pay US$ 106).

13: Client personal information

To confirm and guarantee the Client’s travel arrangements the Client must provide all Client Details with their full payment.

  • If the Client does not provide all details 60 days or more before departure, an Administrative Fee will be charged to the Client.
  • In the client details have not been received by Chaski Green tour operator 45 days prior to trip departure Chaski Green Tour Operator reserves the right to treat the file as cancelled and full cancellation fees will apply. Client Details required will vary tour by tour, and will be advised during the booking process. However, at a minimum Client Details include passport number, passport expiry date, full name as it appears in the passport you are traveling with, date of birth, place of birth, nationality and arrival details (or other documents as requested by Chaski Green Tour Operator).
  • A booking may not be confirmed without provision of Client Details.

14: Passport and visas  

You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip; please refer to the Essential Trip Information for details.  We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.

15: Cancellation

In the event you cancel the Perú Package, trek or tour the following charges will be made:

More than 90 days in advance*: US$ 20% per person

More than 30 days in advance*: US$ 40% per person.

Less than 30 days in advance*: US$ 60% per person.

On or after the starting date*: no refund will be made. There will be no refunds if a passenger leaves a trip for any reason whatsoever, either voluntarily or involuntarily, after it has begun. We will make no refunds for any meals, accommodation or services not used.

Special Notes

  • Payments or deposit for flights bookings are non-refundable due to airlines.
  • In case of postponing the trip, an administration fee of 20% of the trip price will be charged plus the amount already spent on non-refundable subcontracted services. The remaining amount may be used toward future travel with Chaski Green Tour Operator.
  • No refund will be made if you voluntary leave a trip for any reason after the trip has begun. Refunds will be at the discretion of Chaski Green Tour Operator, if you are involuntary forced to leave a trip for any reason. No refunds will be made for any accommodation, transport, sightseeing, meals or services no utilized.
  • It is strongly recommended that full insurance is taken out, which includes cover, under certain circumstances, against the loss of deposit or cancellation charges.

16: Responsibility

We reserve the right to refuse to continue to carry any passenger(s) causing inconvenience or annoyance to other travelers/trekkers, or creating difficulties that would hamper the smooth running of a trip. We shall not be liable for any loss or damage to baggage or personal possessions, or any consequential losses resulting there from. If a traveler/trekker is injured or becomes ill, all evacuation and hospital expenses, doctors’ fees and repatriation costs are the traveler/trekker’s responsibility, and Chaski Green Tour Operator and Travels shall not be liable for any refund of the tour fare.

17: Cancellation by us

Our trips are guaranteed to depart once they have one fully paid traveler unless minimum group size specifically states otherwise. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund.  In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs.  We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

It is the traveler/trekker’s responsibility to have valid passports and all visas and equipment that may be required on the selected tour. We do not accept responsibility for failure to obtain these visas for any reason, and do not accept responsibility for any passports or documents left with us for this purpose.

18: Inclusions   

  • The land price of your trip includes:
  • all accommodation as listed in the Essential Trip Information
  • all transport listed in the Essential Trip Information
  • sightseeing and meals as listed in the Essential Trip Information
  • the services of a group leader as described in the Essential Trip Information

19: Exclusions   

The land price of your trip does not include:

  1. International or internal flights unless specified
  2. Airport transfers, taxes and excess baggage charges unless specified
  3. Meals other than those specified in the Essential Trip Information
  4. Visa and passport fees
  5. Travel insurance
  6. Optional activities and all personal expenses

20: Flight Bookings

  1. Chaski Green Tour Operator will use its best endeavors to ensure that all flight prices are correct at the time that they are quoted. Airlines reserve the right to amend or withdraw fares without prior notice. Once a deposit is paid on an airfare, it guarantees that a booking is being held for you, it DOES NOT GUARANTEE the fare.
  2. The fare can only be guaranteed when the flight booking has been paid for in full and a ticket has been issued.
  3. Flight bookings cannot be transferred. The flight times given by Sun Gate Tours are for general guidance only and are subject to change. Up-to-date flight times will be shown on the tickets.
  4. The Client must check the tickets very carefully immediately upon receipt of the latest timings. Chaski Green Your Operator will endeavor to inform the Client as soon as possible in the event of any flight alteration.
  5. Details of airlines are also subject to change. Such alterations do not constitute a significant change to the trip arrangements and will therefore not be entitled to cancel without paying the normal charges as a result.
  6. Chaski Green Tour Operator cannot be held responsible for any delay to your flight whether this delay is caused by adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, the rescheduling of flight times by the airline, mechanical breakdown, strike, industrial action or any other reason.

21: About Complains!

If the Client has a complaint about any of the tour arrangements he/she must bring it to the attention of the tour leader or other representative of Chaski Green Tour Operator at the time so that they may use their best endeavors to rectify the situation. It is only if Chaski Green Tour Operator is made aware of any problems that there will be the opportunity to put things right. Complaining to Chaski Green Tour Operator as a problem arises during your trip will allow us to remedy the situation or facilitate compensation. Should the problem remain unsolved, a complaint must be made in writing to info@chaskigreen or directly to your Travel Consultant within 28 days of the completion of the holiday or as soon as possible.
